1. Acceptance of Terms
This CredAuction Terms of Use agreement (the “Agreement”) is a legal agreement between you and CredAuction (“we”, “us”, or “our”). By accessing our site or using our auction services, you agree to be bound by these terms without reservation. If you do not agree to these terms, you are not authorized to use the platform.
2. Eligibility & Registration
2.1 Age Requirement: You must be at least 18 years of age to participate in any auction or register an account. By using the site, you represent and warrant that you possess the legal capacity to enter into this Agreement.
2.2 Account Security: You are responsible for maintaining the confidentiality of your login credentials. CredAuction will not be liable for any losses arising from unauthorized access to your account due to your failure to secure your password.
3. License & Restrictions
CredAuction grants you a limited, non-exclusive, non-transferable license to access the site for personal or business use related to property auctions. You agree not to:
- Engage in "screen scraping," "database scraping," or any automated data collection of property listings.
- Impersonate any person or entity or misrepresent your financial capacity to bid.
- Attempt to bypass any security measures or gain unauthorized access to our server systems.
- Reproduce or distribute copyrighted content from our platform without express written consent.
4. Auction Listings & Accuracy
All property listing information is subject to the possibility of errors, omissions, change of price, or withdrawal without notice. CredAuction acts as a facilitator; the final verification of property titles, physical condition, and legal encumbrances is the sole responsibility of the bidder.
5. Intellectual Property
All logos, designs, text, and graphics are the proprietary property of CredAuction or its licensors. Use of these trademarks without prior written authorization is strictly prohibited.
6. Limitation of Liability
To the maximum extent permitted by law, CredAuction shall not be liable for any indirect, incidental, or consequential damages (including loss of profits) arising out of your use of the site, even if we have been advised of the possibility of such damages. The site is provided on an "As Is" and "As Available" basis.
7. Governing Law & Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of India. Any disputes arising under this agreement shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.
