Our Terms & Conditions

These Terms and Conditions ("Agreement") are an agreement between the participants ("Buyers," "Bidders," or "You") and the House Auction ("Auction") organizers.

Eligibility

To participate in the Auction, you must be at least 18 years old and have the legal capacity to enter into a binding contract. By participating in the Auction, you represent and warrant that you meet these eligibility requirements.

Auction Process

  • The Auction will be conducted in an open, competitive bidding format.
  • The Auction will begin at the designated start time and end at the designated end time.
  • The highest bidder at the end of the Auction will be deemed the winning bidder.
  • The winning bidder will be required to sign a purchase agreement and make a deposit of 10% of the purchase price within 24 hours of the end of the Auction.
  • The remaining balance of the purchase price must be paid in full within 30 days of the end of the Auction, unless otherwise agreed upon in writing between the Auction organizers and the winning bidder.

Bidding

  • Bids will be accepted online, in person, or by phone.
  • The Auction organizers reserve the right to reject any bid that it deems to be non-compliant with the Auction rules or that it believes is not in good faith.
  • Bidders are responsible for ensuring that their bids are accurate and submitted in a timely manner.
  • In the event of a tie bid, the Auction organizers will determine the winning bidder through a random drawing or another method at their discretion.

House Information

  • All houses included in the Auction are sold "as is" and "where is" with no warranty or guarantee, express or implied, as to their condition, fitness for a particular purpose, or otherwise
  • The Auction organizers have made every effort to provide accurate and complete information about the houses in the Auction. However, the Auction organizers do not guarantee the accuracy or completeness of any such information.
  • Bidders are responsible for conducting their own due diligence on the houses included in the Auction, including but not limited to inspecting the houses and researching any liens, encumbrances, or other title issues

Termination or Modification of Auction

The Auction organizers reserve the right to terminate or modify the Auction at any time and for any reason, including but not limited to technical difficulties, unforeseen circumstances, or the discovery of inaccuracies in the information provided about the houses in the Auction.

Governing Law and Jurisdiction

This Agreement and any dispute arising out of or related to the Auction shall be governed by and construed in accordance with the laws of the jurisdiction in which the Auction is held. Any legal action arising out of or related to the Auction shall be brought in the courts of the jurisdiction in which the Auction is held.

Disclaimer of Liability

To the fullest extent permitted by law, the Auction organizers disclaim all liability for any loss, damage, or injury arising out of or related to the Auction, including but not limited to any inaccuracies in the information provided about the houses in the Auction or any errors or omissions in the conduct of the Auction.

Entire Agreement

This Agreement constitutes the entire agreement between the Auction organizers and the participants with respect to the Auction and supersedes all prior or contemporaneous communications and proposals, whether oral or written. No modification or amendment to this Agreement shall be binding unless in writing and signed by both parties.

By participating in the Auction, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
